What these terms cover
These terms are between you and the individual operating the independent Spotpanion project, referred to here as Spotpanion, we, or us. They cover this website, its interest form, and any private pre-release testing we make available. By using those services, you agree to these terms. If you do not agree, do not use them.
Development status and eligibility
Spotpanion is still in development and is not publicly downloadable. The website interest form and private pre-release program are intended for people 18 or older. Private access is discretionary and may be limited, changed, or ended while the product takes shape.
Your account and information
If you receive private app access, you are responsible for the accuracy of the information on your account and for protecting your sign-in method. Do not share one-time codes or credentials with anyone, including us; we will not ask for them. How personal information is handled is described in the Privacy Policy.
Acceptable use
Use the website and app lawfully and only for their intended purposes. Do not disrupt the services, probe or bypass security, access another person's account or data, submit malicious or automated traffic, or interfere with other people using the services.
Not medical advice
Spotpanion is a workout tracking tool, not a medical device or a source of medical advice. It does not diagnose, treat, or prevent any condition. Consult a qualified professional before starting or changing an exercise program, and train within your own limits.
Progress, rewards, and virtual items
XP, coins, accessories, and other in-app rewards are gameplay features. They have no cash value, cannot be redeemed or transferred outside the app, and may be adjusted or removed during development.
Content and intellectual property
The Spotpanion software, artwork, design, branding, and site content are protected by applicable intellectual-property laws. You may use the services for personal, non-commercial purposes, but may not copy, redistribute, reverse engineer, or commercially exploit protected materials except where the law permits it. Your workout data remains yours; these terms do not transfer ownership of the information you record to us.
Availability and changes
Early-stage services may contain errors, change without notice, or be unavailable. We may modify, suspend, or end a feature or private access when reasonably necessary for development, security, legal compliance, or operation of the project. You can stop using Spotpanion at any time and may request account deletion through the Delete Account page.
Disclaimers and limits
To the extent permitted by law, the website and private pre-release app are provided as available and without warranties of uninterrupted or error-free operation. Spotpanion is not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of an early-stage service. Nothing in these terms excludes or limits rights or liability that applicable law does not allow us to exclude or limit.
Governing law
These terms are governed by California law, without regard to its conflict-of-law rules. Courts with lawful jurisdiction in California may hear disputes, subject to any consumer rights that require another location or process.
Changes to these terms
We may update these terms as the project changes. A material revision will update the effective date and version above. Continued use after a revision takes effect means you accept the revised terms.
